1. Agreement to Terms

By accessing or using AdvisorHub.ai ("Service," "Platform," "we," "us," or "our"), operated by AdvisorHub LLC, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

AdvisorHub.ai provides AI-powered credit report analysis and funding readiness assessment services. Our Service includes:

• Analysis of uploaded credit reports to assess funding readiness
• Generation of comprehensive funding analysis reports with actionable insights
• Credit profile evaluation and scoring
• Recommendations for improving creditworthiness and funding eligibility
• Future integration with credit data APIs for real-time credit monitoring and analysis
• Storage and management of analysis reports and user data

3. User Accounts and Registration

To use our Service, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Credit Report Upload and Processing

When you upload credit reports to our Service:

• You grant us permission to process, analyze, and store the uploaded credit report data
• You represent that you have the legal right to upload and share the credit information
• You understand that uploaded files are processed using AI and machine learning technologies
• You acknowledge that reports are stored securely and used solely for generating your analysis
• You may delete your uploaded reports and analysis at any time through your account settings

5. Credit Data API Integration

We plan to integrate with third-party credit data APIs to provide enhanced services. When this feature becomes available:

• You will be required to provide explicit consent before we access your credit data through APIs
• We will collect and store credit information obtained through authorized API connections
• You may revoke API access permissions at any time
• We will comply with all applicable credit reporting regulations, including the Fair Credit Reporting Act (FCRA)
• Real-time credit monitoring features will be subject to additional terms and disclosures

6. Billing and Payment Terms

Our Service operates on a credit-based system and subscription model:

• Credits are required to generate analysis reports
• Credit purchases are non-refundable unless required by law
• Subscription plans, when active, automatically renew unless cancelled
• You are responsible for maintaining valid payment information
• We reserve the right to modify pricing with 30 days notice to existing users
• Unused credits do not expire unless your account is terminated for Terms violations
• Business and whitelabel accounts are subject to separate pricing and terms

7. Intellectual Property Rights

The Service, including all content, features, functionality, source code, algorithms, and technology, is owned by AdvisorHub LLC and protected by United States and international intellectual property laws.

Your generated reports and analysis are licensed to you for personal or business use. You may not:

• Reverse engineer, decompile, or attempt to extract our proprietary algorithms
• Resell, redistribute, or create derivative works from our analysis reports without authorization
• Use automated systems to scrape or extract data from the Service
• Remove copyright, trademark, or other proprietary notices

8. Disclaimers and Limitations

• Not Financial Advice: Our analysis and recommendations are for informational purposes only and do not constitute financial, legal, or professional advice
• No Guarantee of Funding: Our funding readiness scores and recommendations do not guarantee loan approval or funding from any institution
• Accuracy: While we strive for accuracy, AI-generated analysis may contain errors or omissions. Always verify information independently
• Third-Party Actions: We are not responsible for decisions made by lenders, credit bureaus, or other third parties based on our reports
• Service Availability: We do not guarantee uninterrupted or error-free service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVISORHUB LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM:

• Your use or inability to use the Service
• Unauthorized access to your data or account
• Errors, omissions, or inaccuracies in our analysis
• Decisions made based on our reports or recommendations
• Service interruptions, bugs, or technical issues

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Data Security and Breach Notification

We implement industry-standard security measures to protect your credit information and personal data. However, no system is completely secure. In the event of a data breach affecting your information:

• We will notify affected users within 72 hours of discovering the breach
• We will provide details about the nature of the breach and data affected
• We will offer guidance on protective measures you should take
• We will comply with all applicable data breach notification laws

11. Prohibited Uses

You may not use the Service to:

• Upload credit reports or data belonging to others without authorization
• Engage in identity theft, fraud, or any illegal activity
• Violate any applicable laws, regulations, or third-party rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to compete with or harm our business
• Harass, abuse, or harm other users or our staff

12. Whitelabel and Business Accounts

Business and whitelabel accounts are subject to additional terms:

• Business accounts may access analysis reports on behalf of their clients
• Whitelabel partners may customize branding, logos, and domain names
• Business users are responsible for obtaining proper consent from their clients
• Separate commercial agreements may apply for high-volume or enterprise usage
• Business accounts must comply with all applicable professional and industry regulations

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violations of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended periods of inactivity
• Any reason at our sole discretion

Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination, after which we may delete your information in accordance with our Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through:

• Good faith negotiations between the parties
• Binding arbitration in Albuquerque, New Mexico, if negotiations fail
• Small claims court for disputes under the applicable monetary threshold

You waive the right to participate in class action lawsuits or class-wide arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you disagree with changes, you must discontinue use of the Service.
